Terms and conditions

I. TEACHING AND SUPERVISION SERVICE

 

Registration for supervised services at Paddle Avenutre implies the pure and simple acceptance of these general conditions by the subscriber, who undertakes to inform each of the participants of all the modalities.

 

ART. 1 - STAKEHOLDERS

 

All the activities offered are supervised and provided by state-certified guides (BEES / BPJEPS / CQP) and meeting their legislative obligations (URSSAF, RCP, DDCSPP declaration, professional cards).

 

ART. 2 - REGISTRATION AND RESERVATION

 

All our activities are by reservation. For this, you have several solutions: by filling out the online reservation form (www.paddleaventure.fr) or by contacting Entre Terre et Mer directly by email (informations@paddleaventure.fr), by phone (+33640325475) or at the reception of our base at the Plage du Veillon.

COLLECTIVE EXITS: Registration is effective upon receipt of the check or deposit for the service and a booking confirmation email for the chosen trip.

PRIVATE OUTINGS (institutions, companies, associations): Registration is effective upon receipt of the check or deposit transfer for the service and a booking confirmation email for the chosen outing.

 

ART. 3 - PRICE

 

Paddle Aventure prices are presented on the website and on the activity flyer available at reception.

 

The prices include: the organization, the supervision provided by a state-certified guide and the loan of equipment (life jacket, paddle, unsinkable kayak and self-bailing machine).

 

The prices do not include: transport to the place of activity (meeting place and practice site) and personal costs.

 

 

ART. 4 - PAYMENT METHOD

 

For supervision services, the regulations must be sent and made out to the attention of Paddle Aventure. This mention will be stipulated when booking.

 

Means of payment accepted: check, credit card (secure internet payment) or cash.

 

ART. 5 - CONDITIONS OF PARTICIPATION

 

Our activities are open to everyone; however, depending on the activities and routes, certain conditions must be taken into account (age limit, ability to swim, technical level, physical condition, etc.).

 

ART. 6 - INSURANCE AND LIABILITY

 

Each professional is insured in Professional Civil Liability for the activities which are specific to him and for the costs occasioned by a possible rescue operation.

 

We strongly advise each participant to be covered by civil liability insurance and / or an individual accident with the insurance of his choice for the practice of water sports. In fact, we cannot replace the individual civil liability of each participant.

 

Paddle aventure is insured for civil liability for all the activities it offers and cannot be held liable for activities booked with other providers.

 

In the event of a bodily accident, the responsibility of Paddle Aventure and the intervening instructor is released as soon as the victim is taken care of by the competent rescue organizations, and any hospital consequences will be the responsibility of the accident victim's personal insurance.

 

The participant / client is responsible for the equipment loaned to him for the activity. The professional cannot be held responsible for any damage that may be caused by the equipment made available.

 

In the event of theft or deterioration of the loaned equipment, the participant / customer may be asked for compensation related to wear or a full refund of the equipment.

 

The professionals of Paddle Aventure cannot be held responsible for the loss, theft (including in vehicles) or the breakage of objects (eg: glasses, cameras ...) that the practitioners could take with them during the activity. and able to support during the activity.

 

ART. 7 - CANCELLATION / INTERRUPTION BY THE CUSTOMER

 

7.1 Cancellation by the customer

 

- Cancellation of a reservation for more than 3 days: the amount is refunded;

 

- Cancellation of a reservation within 2 days: a deposit of 25% is kept;

 

- Cancellation of a reservation the same day: the balance is kept.

 

In the event of force majeure and on presentation of proof (medical certificate, death of a loved one), Paddle Aventure can reimburse the amount paid, but cannot be demanded by the customer. In all cases, the customer undertakes to notify Paddle Aventure of all notifications relating to the reservation: organization of the program, change in staff, delay or cancellation.

 

7.2 - Interruption during the service

 

In the event of an interruption during the service, the client or participant may not claim any reimbursement.

 

ART. 8 - CANCELLATION / EXCLUSION BY PADDLE AVENTURE

 

8.1 - Cancellation

 

Paddle adventure instructors reserve the right to cancel or adapt the outing depending on weather conditions or the level of the participants.

 

The activity can be canceled for safety reasons (meteorology, floods, etc.) or for any other case of force majeure. In this case, a replacement activity will be organized as far as possible or another date will be offered. If the exit cannot be carried out, the service is fully reimbursed without being able to claim any other compensation.

 

In the event of a cancellation by us due to an insufficient number of participants (less than 5 people), registrants will be fully reimbursed and will not be able to claim any compensation.

 

8.2 - Exclusion

 

The Paddle aventure instructors reserve the right to exclude a participant who is intoxicated or whose behavior is likely to disturb the smooth running of the activity or to compromise the safety of the group. In this case, the client or participant will not be able to claim any reimbursement or compensation.

 

ART. 9 - APPOINTMENT

 

A meeting time and place are systematically communicated regardless of the service. For the smooth running of the activities and out of respect for the other participants and the professional supervising you, we kindly ask you to take note of these indications previously transmitted by us. Be sure to anticipate your trips so as to be punctual. We tolerate a delay of up to 15 minutes. Beyond this period, the instructors go into activities and no reimbursement or compensation will be payable.

 

ART. 10 - SUPERVISION OF YOUNG PEOPLE (MINORS):

 

Minors unaccompanied by an adult (legal guardian) are not accepted in so-called “collective” activities.

 

Minors in the CVL / CLSH / School context:

 

The organization organizing the stay or outing must be able to provide the instructor and Paddle Adventure, for each participant (young people and animator)

 

- a test prior to nautical activities,

 

- the health card of each participant.

 

On the other hand, Paddle aventure undertakes to provide the certificates and documents necessary for the organization of the outing (DDCSPP accreditation, insurance, diplomas of supervisors, etc.)

 

Each group of minors must be accompanied by 2 adults including a center leader and the instructor supervising the activity.

 

ART 11. GIFT VOUCHER

 

The gift voucher is effective upon receipt of the full amount of the service.

 

The order form is nominative, but its validity is limited to the current year.

 

The recipient of the gift voucher must contact us to book the outing.

 

The activity of the gift voucher can be replaced by another activity offered by Paddle aventure, provided that the value of the latter is less than or equal to the activity mentioned on the gift voucher. On the other hand, it is possible to carry out an activity for a higher amount by paying the difference.

 

PLEASE NOTE: The gift voucher has an expiration date. After the period of validity (current year), the service will be considered as executed and cannot be postponed. The beneficiary and / or the buyer cannot claim any reimbursement or compensation.

 

The gift voucher and the nominative document must be presented on the day of the outing to the instructor in charge of the session.

 

The outing will be guaranteed in the event that the minimum number of participants required is assured and in the event that the weather conditions allow good practice of the activity.

 

ART. 12 - SETTLEMENT OF DISPUTES

 

The parties will endeavor to amicably resolve any difficulties that may arise in the performance of the contract. If no amicable agreement could be reached, all disputes relating to the validity, interpretation and execution of this agreement will be governed exclusively by the rules of French law.

 

All disputes, of whatever nature, will fall under the jurisdiction of the French civil and commercial courts, including ruling on summary proceedings.

 

II. EQUIPMENT RENTAL

 

ART. 1 - RESERVATION

 

All our activities, including equipment rental, are by reservation. For this, you have several solutions: by contacting Paddle aventure directly by email (informations@paddleaventure.fr), by phone (+33640325475) or at the reception base at the Plage du Veillon.

 

ART. 2 - NAVIGATION ZONE

 

You are asked to respect the navigation zones and times because of the tides.

 

The times are mentioned when the equipment is handed over. In the event of a late return or failure to respect the place of return, an increase of € 50 will be required and due.

 

ART. 3 - PRICE

 

Rental prices are displayed on the website, at reception and on the flyer available at reception.

 

Prices include: rental of technical equipment.

 

Below are the different rental formulas:

 

Rental by the hour, 2 hours and half a day.

 

The prices do not include: transport to the place of activity (meeting place and practice site) and personal costs.

 

ART. 4 - PAYMENT METHOD

 

The payment must be sent (wording), payable to Paddle aventure .

 

Methods of payment accepted: check, bank transfer, credit card (secure internet payment) or cash.

 

ART. 5 - INSURANCE AND LIABILITY

 

The customer practices under full responsibility and at his own risk the activity for which the said equipment is rented. Paddle aventure cannot be held responsible in the event of an accident that may occur during the said unsupervised activity.

 

The Paddle Adventure team does not have the means to check the level of sports practice of its clients, it is therefore up to each participant / client to have assessed his physical form, his knowledge and his skills according to what he wishes to achieve.

 

ART. 6 - INSURANCE

 

Paddle aventure is insured in Professional Civil Liability for its own activities and cannot be held liable for any incident or accident that may occur during an unsupervised activity.

 

In addition, we strongly advise each participant to be covered by civil liability insurance and / or an individual accident with the insurance of his choice for the practice of water sports.

 

The participant / client is responsible for the material assigned to him. Paddle aventure cannot be held responsible for any damage that may be caused by this material. In the event of theft, loss or deterioration of the rented equipment, the participant / customer will be asked for compensation related to wear or a full refund of the equipment.

 

Paddle aventure cannot be held responsible for the loss, theft (including in vehicles) or the breakage of objects (ex: glasses, cameras ...) that the practitioners could take with them during the activity and which can provide during the activity.

 

ART. 7 - CANCELLATION / INTERRUPTION BY THE CUSTOMER

 

7.1 Cancellation by the customer

 

In the event that the customer has paid a deposit, below are the reimbursement clauses:

 

- Cancellation of a reservation more than 3 days: the deposit is refunded;

 

- Cancellation of a reservation within 2 days: the deposit of 25% is retained;

 

- Cancellation of a reservation on the same day: the balance will be required.

 

In the event of force majeure and on presentation of proof, Entre Terre et Mer may reimburse the amount paid, but may not be demanded by the customer.

 

In any case, the customer undertakes to notify Paddle aventure of all notifications relating to the reservation: organization of the program, change in staff, delay or cancellation.

 

7.2 Cancellation by Paddle aventure  

 

Paddle aventure reserve the right to cancel an activity for safety reasons (meteorology, tides, etc.) or for any other case of force majeure. In this case and as far as possible, another date / time slot will be offered to the customer. If the exit cannot be carried out, the sum paid will be fully reimbursed without being able to claim any other compensation.

 

7.3 Exclusion / refusal of activity

 

Paddle aventure reserves the right to refuse the rental of equipment to a participant whose level of competence does not allow them to practice the activity alone in safety or whose behavior is likely to compromise their own safety and that of the group accompanying them. . In this case, the client or participant will not be able to claim any reimbursement or compensation.

 

ART. 8 - YOUTH (MINORS):

 

Unaccompanied minors: Minors under the age of 18 unaccompanied by an adult (legal guardian) are not entitled to rent equipment.

 

ART. 9 - SETTLEMENT OF DISPUTES
